Phillip Wotton has been practising insurance law for 38 years.  Prior to establishing Wotton + Kearney in 2002, Phillip was an insurance partner with Phillips Fox for 24 years.

Phillip has conducted many major cases involving issues related to all these product lines.  He is well-known in the Australian insurance market and the legal profession as a pre-eminent insurance lawyer.

Phillip has been included in the Legal Who's Who Australia.

Phil's recent matters include:

  • acting for the ISR insurers in one of the largest material damage and business interruption claims in the history of the Australian market arising out of a major fire;
  • acting for the D&O insurers in relation to a multi-billion dollar US Securities class action in New York arising out of various capital raisings involving a Singapore-registered public company;
  • acting for and negotiating a settlement on behalf of the contract works insurer of the Melbourne City Link Project of major litigation relating to defects in the Burnley Tunnel;
  • acting for and negotiating the settlement of a major material damage and business interruption claim involving a nickel and uranium processing plant;
  • acting for and negotiating the settlement of a major material damage and business interruption claim involving a natural gas processing plant;
  • acting for ISR business insurers in numerous material damage and business interruption claims involving the mining industry and in particular, underground coal mines;
  • acting for and negotiating a settlement on behalf of the insurer with respect to a malicious product tamper claim involving a major pharmaceutical company;
  • acting for and negotiating a settlement on behalf of the insurer with respect to a political risks claim involving a Solomon Islands gold mining company;
  • acting for and negotiating settlements on behalf of the liability insurers of a private school concerning a major class action involving sexual abuse claims;
  • acting for and negotiating a settlement on behalf of lawyers sued in the 1 O'Connell Street litigation, a claim for in excess of $200 million;
  • acting for and negotiating a settlement on behalf of the defendants in one of the highest dollar value personal injury claims in Australia arising out of a motor racing accident;
  • acting for the construction risk insurers and negotiating the withdrawal of the claim relating to the Third Runway Project at Sydney Airport;
  • successfully defending oyster growers in a product liability class action arising out of the Wallis Lake Hepatitis A outbreak; and
  • acting for D&O insurers in relation to a class action against the directors of a major public company arising out of their attempts to reform the Australian waterfront by replacing their union workforce with non-union labour.
