Cain was admitted to practice in Victoria in 1998 and joined Wotton + Kearney in July 2007 to establish the firm's Melbourne office.
Cain's insurance experience is broad but he has forged a strong reputation in the professional indemnity, financial institutions and D&O liability areas. In this capacity, he has been involved in numerous significant, high profile claims, particularly in the financial services and construction fields.
He acts for both local and foreign insurers including the Lloyd's of London and London company insurance markets. He has forged a reputation for providing high quality, accessible and commercial advice in a cost-effective manner.
Cain's recent matters include:
- acting for the professional indemnity and D&O liability insurer of the Opes Prime Group (losses estimated at between $600 million and $1 billion);
- acting for reinsurers and catastrophe loss insurers of a major Australian bank in relation to misselling claims exceeding $400 million;
- acting for multiple insurers in relation to their professional indemnity and D&O exposure to the $300 million collapse of the Westpoint group of companies;
- acting for directors of a staff superannuation fund of one of Australia's largest financial service providers in relation to disqualification proceedings by APRA under the Superannuation Industry (Supervision) Act (regarded as a leading case in this area);
- acting for consultant engineers in relation to a $450 million claim for misleading and deceptive conduct concerning one of Victoria's largest infrastructure projects;
- advising insurers on the policy implications of the activities of unregistered foreign managed investment schemes in Australia with a specific focus on the US "life settlements" industry; and
- handling all professional negligence claims for one of Australia's largest private client stockbroking organisations.

Cain is a committee member of the Victorian Branch of the Australian Insurance Lawyers Association. He is a member of the Victorian Branch of the Australian Professional Indemnity Group and the Litigation Section of the Law Institute of Victoria.
