Andrew is a partner of Wotton + Kearney and has over 12 years experience in acting in contentious litigated and unlitigated claims.  He acts for construction and engineering professionals and insurers of construction risks.  Andrew has particular expertise in advising and acting in relation to D&O and financial institution claims.  Andrew's practice also involves acting for parties in commercial litigation and providing advice to industrial special risk, commercial property and marine insurers.

A common theme to Andrew's practice is his commercial and timely advice and hands-on approach to his work.  Andrew coordinates and manages large-scale litigation.

Andrew's recent matters include:

  • acting on behalf of a design and construction contractor in relation to the catastrophic failure of a waste processing plant.  That claim involved defending a $60 million claim by the principal and seeking to recover the contractor's losses and from its design engineer and insurers;
  • advising a D&O and professional indemnity insurer with respect to claims arising out of the collapse of agricultural managed investment schemes in Australia;
  • advising an insurer with respect to one of the largest fidelity losses in the country;
  • advising with respect to claims against hedge funds, financial planners and accountants arising out of losses suffered as a consequence of the global financial crisis;
  • advising with respect to liability claims arising out of bushfires;
  • advising with respect to claims made by ASIC and the ACCC;
  • advising with respect to insurance cover available to a design and construct contractor which was responsible for the refurbishment of a nuclear reactor;
  • acting on behalf of marine insurers with respect to cargo and liability claims; and
  • acting on behalf of the professional indemnity insurer of an engineer responsible for the design of the gas exhaust systems for two powerstations.

Andrew has also played a key role in settling a $90 million insurance claim with respect to a spontaneous combustion heating which led to the loss of long wall mining equipment and the closure of a substantial section of an underground coal mine in Queensland.
