Tom joined our team in December 2009 and is a Senior Associate in our Sydney office.  He was previously employed as a Senior Associate with a well known Insurance Law Firm in the Sydney CBD. 

With more than 10 years post-admission experience, Tom has provided advice and conducted litigation on behalf of insurers, self-insurers, reinsurers and insured's in most Australian jurisdictions.

Tom’s extensive insurance defence litigation experience includes matters relating to building and construction, building site contract works, public and products liability and professional indemnity where he has mainly acted for brokers, engineers, architects, medical professionals, valuers and agents. Tom is an active member of the firms Construction and Public and Products liability focus groups.

Tom's recent matters include:

  • acting in large value construction litigation involving the Strata Owners Corporation, the builder, and the Interior Designer in the Supreme Court of NSW;
  • acted for an engineering company in Supreme Court proceedings with respect to works involving alleged defective design of waterproofed concrete slabs;
  • defence of claim by an insured against its insurer for indemnity pursuant to its policy of insurance in the District Court; 
  • acting for and defending various public liability claims instituted against one of the largest owners of shopping centres in Australia;
  • successfully defending a claim made against financial brokers in complex District Court proceedings arising from default loan repayments in circumstances where allegations of negligent misrepresentation were made against the professional;
  • acting in a number of contract works matters involving property damage to Telstra fibre optic submarine communication cables resulting in claims for business interruption by various stake holders;
  • acting for a government authority in relation to potential claims arising from the 2009 Black Saturday Bushfires in Victoria;
  • acting for a manufacturer of cattle feed which is alleged to have been contaminated by reason of negligent advice resulting in the injury and death of livestock;
  • acted for engineers, architects and surveyors in relation to alleged negligent advice;
  • acted for a Government Body in defence of a large professional indemnity claim arising from injuries sustained following an allergic reaction subsequent to a medical procedure;
  • acted in numerous occupier's liability claims on behalf of owners, managers, contractors and cleaners of commercial retail premises in relation to personal injury claims;
  • advised insurers, reinsures and insured's in relation to policy coverage issues; and
  • appeared as an advocate on behalf of insurers at mediations and interlocutory applications.
