Murray specialises in employment and discrimination law and practice. He has a wide range of experience in all aspects including general HR issues (misconduct, performance management and restructuring), discrimination (including bullying and harassment), whistleblowing and privacy.

Before coming to New Zealand in 2017, Murray practised as a civil litigation barrister in England and Wales and has a considerable advocacy background in mediations, tribunals and courts. Since arriving in New Zealand, he advises and represents in mediations (including in the Human Rights Commission), the Employment Relations Authority (ERA), and the Human Rights Review Tribunal (HRRT).

His sector experience is varied and most recently includes healthcare, education, real estate, public sector and retail. His experience includes health and safety and data protection/privacy issues.

Murray also has considerable experience assisting healthcare professionals in New Zealand with professional indemnity and employment issues.

Employment Practices Liability

  • Advising and representing in claims to the ERA involving unjustified disadvantage and dismissal including claims for reinstatement.
  • Advising and representing employers in relation to personal grievances and EPL claims in the education, healthcare, real estate sectors.
  • Advising and representing in discrimination and harassment claims in the Human Rights Commission.
  • Providing pre-claim advice to employers on employment processes including conduct, performance management and restructuring/redundancy, as well as restorative and facilitative processes.
  • Writing and reviewing employment agreements and policies including policies regarding sexual harassment and bullying.

Professional Liability

  • Advising and representing an education provider in a claim for preventing access to education on grounds of disability.
  • Advising and representing a contractor in the defence of a High Court claim for breach of fiduciary obligations and restraints of trade.

Healthcare + Life Sciences

  • Advising and representing a healthcare provider in relation to a privacy claim in the HRRT for unauthorised access to notes by an employee.
  • Advising and representing healthcare professionals in relation to clinical review processes and professional conduct investigations by employers and regulators.
  • Providing general contract, employment and privacy advice to members of MPS and the NZDA.
  • Assisting healthcare providers with regulatory processes including complaints to the HDC, Medical Council and Psychologists Board, associations, etc.
  • Acting for healthcare providers in the Health Practitioners Disciplinary Tribunal.
