Nadica specialises in professional indemnity matters and defends professionals in the construction, environment, and property sectors. She acts for local and overseas-based insurers and provides coverage advice and is experienced defending professionals in disciplinary proceedings and complaints from professional bodies.

She is committed to delivering the best possible commercial outcomes and her ability to do so has been enhanced by her experiences working in-house and her secondments at two global insurers

Nadica has a keen interest in contributing to pro-bono projects. She has previously completed an internship in Paris within a Pro-bono division of a law firm and has assisted various community legal centres by providing general legal advice.

Professional Indemnity

  • Acting on behalf of a barrister in appealing a disbarment in the Court of Appeal with regard to challenging findings of professional misconduct relating to alleged tax failures and fraud and whether there was a reasonable excuse.
  • Representing an engineering firm and its insurer in multi-party proceedings brought by the owners and tenants of neighbouring properties to a construction site.
  • Defending both private and council-appointed certifiers in professional negligence proceedings before the Supreme and District courts of NSW, involving the scope of a certifier’s duty of care in both residential and commercial construction projects.
  • Acting as defence counsel for an insurance broker in proceedings involving an alleged failure to procure appropriate public liability and business cover insurance for a business made up of several subsidiary companies.
  • Acting on behalf of a real estate agent in Federal Court proceedings regarding allegations of misleading and deceptive conduct with regard to the sale of a home.
  • Responding to complaints and disciplinary actions before bodies such as the NSW Bar Association and the NSW Civil and Administrative Tribunal.

Subrogated Recoveries

  • Acting for a local insurer and their insured in a recovery action against a contractor for costs relating to flood damage to property and items owned by third-parties in a commercial storage warehouse.
  • Acting for an insurer in a recovery action regarding damage to a commercial premises from a fire caused by welding works. Proceedings were issued against a contractor, occupier, and the occupier’s insurer under s 5 Civil Liability (Third Party Claims Against Insurers) Act who had denied indemnity to the occupier, and the occupier was being deregistered.
