Rachel is an experienced insurance litigator with expertise in general liability claims, including claims involving personal injury, public liability, professional indemnity and intentional torts.
Rachel acts for commercial and government insurers and self-insured organisations in common law negligence claims, which often involve complex and novel legal issues. She has notable experience in dealing with institutional abuse matters and intentional tort claims.
Rachel develops effective claim management strategies for both litigated and non-litigated matters, advising on indemnity issues, as well as the assessment of liability, quantum, contribution and recovery. She also provides counsel on policy issues frequently associated with complex and high-profile litigation.
Before joining Wotton Kearney, Rachel worked in a senior in-house litigation role within a Commonwealth agency, where she managed the conduct of civil litigation proceedings and class actions in all jurisdictions on behalf of the department.
Rachel has also been recognised in Australasian Lawyers’ Rising Stars 2022.
- Representing a university residential college in defending a novel negligence claim in the ACT Supreme Court and Court of Appeal.
- Successfully defending a claim for negligence, breach of fiduciary duty, and misleading and deceptive conduct brought against a solicitor in the ACT Supreme Court.
- Appearing in an interlocutory application in the ACT Supreme Court seeking summary judgment in a claim for professional negligence against a solicitor.
- Acting for the Commonwealth in a claim for negligence and false imprisonment in the NSW Supreme Court.
