He has acted on claims involving securities class actions, defending directors and officers, coverage disputes involving issues under D&O, professional indemnity and management liability policies and coverage issues under ISR and contract works policies.
Richard’s insurance advisory work includes reviewing insurance programs, D&O coverage issues and insurance aspects of infrastructure projects.
Richard has conducted litigation across NSW, Western Australia, the Federal Court of Australia, an appeal before the High Court of Australia and an inquiry before a Special Commission of Inquiry in NSW.
D&O and Class Action
- Acting for the former managing director of Forge Group Limited in two pieces of litigation arising out of the collapse of Forge Group Limited in February 2014.
- Acting for Morgans Corporate Limited which is the fourth respondent in a securities class action proceeding commenced against it in the Federal Court of Australia against it and other parties including former directors of QRxPharma Limited and solicitors, Dibbs Barker.
PI
- Acted for a mortgage originator in its defence of a cross-claim against in in the Supreme Court of New South Wales in which claims were made against it by a borrower against whom related proceedings were bought by the lender in the Possession List.
- Acting for a property valuation and advisory firm in a claim brought in the Supreme Court of NSW in which the plaintiff alleged that a valuation of a commercial property was negligent.
Insurance Coverage Disputes
- Acting for an insurer in its defence of an insurance coverage claim brought to the Supreme Court of NSW concerning the plaintiff’s entitlements to coverage under a Contract Works Insurance Policy.
- Acting for an insurer in proceedings commenced against it by its insured Australian Executor Trustees Limited concerning a dispute over AET’s entitlement to insurance cover in respect of claims that are propounded against it in two class action proceedings.
