His first party property experience includes acting for a large local insurer in a long running dispute with a cover holder regarding damage to an industrial plant. He regularly provides coverage advice on complex and major losses, which more recently has included losses caused by the February 2022 floods in south-eastern Queensland and northern NSW. This work led to his secondment to a large local insurer as a complex/major loss claims handler.

He has acted in numerous high-profile class actions and complex multi-party litigation, including the 2014 Parkerville bushfire litigation in Western Australia and the 2018 St Patricks Day bushfire litigation in Victoria. Off the back of this work, Tully has worked on secondment at one of Victoria’s largest electricity distributors where he advised various business units. Tully has a strong grasp of the Victorian electricity network and the insurance issues it faces.

Property – Major Loss

  • Advising various local insurers on policy response following the March 2021 floods in northern NSW and the February 2022 floods in south-eastern Queensland and northern NSW.
  • Acting for a large local insurer in a long running dispute with a coverholder regarding damage to a large industrial plant.

Class Actions

  • Representing Victoria’s largest electricity distributor and its insurers in defending eight actions arising out of the 2018 St Patrick’s Day bushfires. Tully instructed at the trials of two of the proceedings which all settled at a discount.
  • Representing a maintenance contractor in the 2014 Parkerville Bushfire litigation in Western Australia, which involved five related proceedings.

Construction + Contract Works

  • Advising various insurers on policy response for defective building works claims from single residential buildings to large developments.

Property Damage

  • Representing an electricity distributor and its insurer in defending a claim in negligence by a large telecommunications service provider arising out of an electrical arc explosion in Melbourne’s CBD. The claim resolved for substantially less than what the claimant sought.
